Contract The contract, once formed is between the holidaymaker (who represents all parties staying at the property) and the owners, J.H.Cooper & Son (Ilkley) Ltd . No contract exists until a completed booking form has been received by the owners with a deposit of £70, and their confirmation of the booking has been despatched. Thereafter the holidaymaker becomes liable for the balance of the rent and this must be paid four weeks before the commencement of the holiday. The booking shall be deemed to be for the purpose of the people whose names appear on the booking form. The maximum number of persons allowed at the property is clearly stated in the particulars and must not be exceeded without prior consent of the owner. The owner will have the right to refuse entry to the property should the number of people within the party exceed the maximum number. In this instance this will be considered a breach of contract. Cancellation. If you cancel a booking for which you have contracted, the owners will do what they can to re-let the property, and if they are successful, they will refund any payment made by you. If they are unable to re-let the property, then you will remain liable for the balance of rent (if not already paid) and there shall be no obligation on their part to repay or forego any rent paid or unpaid. If the owner cancels the booking, the full refund plus 10% will be given, but thereafter the holidaymaker will have no further claim against the owners. Insurance The holidaymaker is responsible for holiday insurance to cover all parties using the property. This includes personal insurance, including cancellation insurance and personal effects. The owners are not liable for loss of any personal effects or personal injury whilst on the premises. Safety. Every care has been taken to ensure that the safety of the holidaymaker is catered for. Nevertheless, the holidaymaker has any concerns over safety, this should be reported to the owner immediately. Upkeep of the Property. The property is maintained to a high standard and is well equipped and the holidaymaker must ensure that it is kept clean and tidy and care is not taken not to damage the property or its contents. All damages must be reported to the owner and paid for prior to departure. This property is strictly NO SMOKING and the holidaymaker is therefore agreeing to no smoking within the property. The holidaymaker is also accepting that NO PETS are allowed within the property. Access. The holidaymaker will permit the owner at reasonable times and on reasonable notice to enter and inspect, and if necessary to repair the property, or to enter the property without notice in an emergency to repair the property. Facilities. Facilities are expected to be as described on the website with the possibility of small exceptions. All bed linen is supplied free of charge and towels are provided. Electricity and fuel is free of charge. Complaints. If the holidaymaker has a genuine complaint, this should be made to the owners immediately. Should qualified complaints be made against the holidaymaker this will be considered breach of contract. Nuisance The holidaymaker must ensure that nothing happens which may be a nuisance or inconvenience to occupiers of neighbouring or adjoining property or adversely affect the insurance of the property. Arrival/Departure. Arrival day is on Friday for all weekly and weekend bookings unless alternative arrangements are made between the holidaymaker and the owner. Check in time is 3pm on the day of arrival and check out time on the day of departure is 10am. These conditions shall be deemed to have been accepted by the holidaymaker at the time of booking
